View In: ArcGIS Online Map Viewer

Name: EnforcementAreasMaster

Display Field: basinname

Type: Feature Layer

Geometry Type: esriGeometryPolygon

Description:
This public layer view shows the approximate areas covered by water distribution projects in Montana. In each project a district court has appointed one or more water commissioners to distribute water from a source according to water right priority. Each polygon is one project, labeled with its project number and source, for example E001 Musselshell River. The layer includes active projects and inactive historical projects. Status is Active (active in 2026), Active in 2025 (active in 2025 but not renewed in 2026), or Inactive (historical). It powers the Distribution tab of DNRC's WaterMapper application, where the public can see which projects are active and which water rights are included. DNRC Adjudication, Enforcement, and Distribution Bureau staff also attach the related court orders and water right tabulations to each feature. The polygons show the general drainage area of each project. They are not boundaries officially designated by a district court or the Montana Water Court.

Background: Montana water rights follow the prior appropriation doctrine ("first in time, first in right"). When shortages or conflicts arise, water users can petition their district court to appoint a water commissioner (MCA 85-5-101). The district court appoints and supervises the commissioner (MCA 85-2-406) and may ask the Montana Water Court for a tabulation, which lists the water rights included in the project by priority. The Water Court orders DNRC to compile the tabulations and maps, reviews them, and sends them to the district court for the commissioner to use. DNRC supports the courts and commissioners with water right data, education, and training.

Sources: Created by the Montana DNRC Water Resources Division in May 2024 and updated annually. The Adjudication, Enforcement, and Distribution Bureau and the Technical Project Services Bureau maintain it. Project numbers, sources, counties, basins, and status come from DNRC's distribution project records. Polygon boundaries were built from existing watershed shapes. Some came from DNRC's Montana Water Right Administrative Basins dataset. Others came from USGS Watershed Boundary Dataset (WBD) HUC 12 and HUC 10 hydrologic units, which are distributed with the National Hydrography Dataset (NHD). DNRC selected, combined, or edited these shapes as needed. Some field names use the older term "enforcement" (for example EnfNo). They refer to distribution projects, which are separate from water right enforcement under Montana law. HUC, basin, and GNIS values carried over from those sources reflect the version used and may not match the current WBD or DNRC basin data.

More information: https://dnrc.mt.gov/Water-Resources/Water-Rights/Water-Distribution-and-Commissioner-Resources ; WaterMapper: https://experience.arcgis.com/experience/cde31f7944ea4fe883b3c465388c2055 ; MCA 85-5-101: https://archive.legmt.gov/bills/mca/title_0850/chapter_0050/part_0010/section_0010/0850-0050-0010-0010.html ; MCA 85-2-406: https://archive.legmt.gov/bills/mca/title_0850/chapter_0020/part_0040/section_0060/0850-0020-0040-0060.html ; Water Commissioner Training Manual: https://dnrc.mt.gov/_docs/water/Distribution/Webpage_Assets/Manuals_and_Guidance/WC-Manual-Final-2025.pdf

Use limitations: Boundaries are approximate and meant for general reference at regional scales. Because many follow whole HUC or basin polygons, a project area may include land and water outside the project or leave out tributaries that are part of it. The polygons do not decide which water rights are in a project. The district court order and the water right tabulation for each project are the authority. Status and project details are updated annually and may not reflect recent court actions. In 2026 the courts began requiring projects to be formally renewed. A status of Active in 2025 means a project was not renewed for 2026. It does not confirm that the project has stopped distributing water. For water commissioner contact information, contact the local district court.
